Terms and Conditions

Issued by Digital Marine, LLC, doing business as "Moor" and "Moor Yacht Crew" ("Moor," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the MoorCrew.com website, mobile application, internal matching and messaging tools, crew profiles, employer postings, ad displays, the Moor Ads Portal hosted via third-party systems (e.g., Go High Level), and all services offered by Digital Marine, LLC (collectively, the "Platform").
By creating an account on the Platform, you are entering into a binding legal agreement with Digital Marine, LLC and expressly accepting these Terms in their entirety, including the prohibitions on automated access and data harvesting in Section 7A. If you do not agree to these Terms, you must not create an account or access any gated features of the Platform.
1. Purpose of Moor
Moor is a digital platform designed to connect yacht crew ("Crew") with yacht owners, brokers, captains, management companies, and other maritime professionals ("Employers").
Moor provides tools to:
- create and manage crew profiles
- post and browse jobs
- communicate through in-app messaging
- store credentials in a digital locker
- integrate with optional third-party verification providers such as Crewdentials
Moor facilitates introductions only. Moor does not employ Crew, does not place Crew, does not contract with Crew or Employers, and does not represent or negotiate on behalf of either party.
2. Account Registration
To access certain features, users must create an account and agree to:
- provide accurate and current information
- maintain confidentiality of login credentials
- notify us of any unauthorized access
We may suspend or terminate accounts for:
- false or misleading information
- unprofessional conduct
- abusive behavior
- violation of these Terms
3. Services and Fees
3.1 Crew
Crew receive:
- free profiles
- up to two active posts
- optional paid upgrades (e.g., Spotlight)
3.2 Employers
Employers receive:
- two free job posts (90-day expiration)
- paid upgrades including: Urgent Hire, PRO plans, Concierge services
3.3 Payments
All payments are processed securely through Stripe or authorized providers. Moor does not store cardholder data. All fees are final unless otherwise required by law. Refunds for technical issues or duplicate charges may be offered at our discretion.
4. Our Role and Disclaimer of Guarantees
Moor is an online information-sharing platform. We do not:
- guarantee a job will be filled
- guarantee a Crew member will be hired
- guarantee the accuracy or legitimacy of user-provided content
- verify credentials except through third-party partners
- endorse any Crew member, Employer, or vessel
- supervise interviews, safety standards, or employment conditions
We believe users and listings are as represented, but we are not liable for misrepresentations or misconduct by others.
5. Disclaimers, Representations & Limitations of Liability
5.1 General Information Only
Information provided through Moor is informational and does not constitute safety, legal, immigration, compliance, or employment advice.
5.2 User-Provided Information
Users are solely responsible for the accuracy of their profiles, job posts, uploaded documents, certification validity, and vessel details. Moor does not guarantee the authenticity or accuracy of user content.
5.3 Algorithm & Matching Disclosure
Moor uses automated systems to assist with matching, ranking, and filtering. These systems support human decision-making, do not guarantee performance or outcomes, and do not replace due diligence. Employers remain solely responsible for independent verification, interviews, compliance checks, and legal evaluations.
5.4 No Employment Agency
Moor is not a recruiter, a maritime placement agency, an employer, or a representative of Crew or Employers. Employment decisions are strictly between Crew and Employers.
5.5 User Interactions
Moor is not liable for cancellations, no-shows, withdrawals, safety incidents aboard vessels, contract disputes, damages, loss, injury, misconduct, or immigration, visa, tax, payroll, or maritime compliance errors.
5.6 Payments & Refunds
Moor does not store financial information. Refunds are discretionary unless required by law.
5.7 International Use
Users must comply with applicable local laws, including maritime, tax, and employment rules in their respective jurisdictions.
5.8 Data Security
Platform data is stored in the United States. Verification data stored by Crewdentials is handled under their own policies and may be stored in the U.K. Moor does not sell personal data.
Platform data — including crew profiles, employer information, and job listings — may not be used to train, fine-tune, test, or otherwise develop artificial intelligence, machine learning, or large language models, whether by automated means or otherwise. Any such use constitutes a material breach of these Terms.
5.9 Right to Decline or Remove Content
We may remove misleading posts, fraudulent employers, abusive users, competitor advertisements, or unsafe or inappropriate content. Acceptance of a post or ad does not commit Moor to future acceptance.

6. Verification & Credential Storage
Crew may store documents in a digital locker. Crew choose who can view these documents. For third-party verification, Moor uses partners such as Crewdentials. Crewdentials independently manages and stores data. Moor does not collect, store, or control verification documents.
7. User Conduct
Users agree not to:
- upload false, defamatory, or unlawful content
- harass, abuse, or scam others
- post copyrighted content without rights
- engage in automated access, scraping, or data harvesting of any kind — see Section 7A for the full prohibition
- misuse the platform or interfere with its operations
Violations may result in immediate account termination and may expose the violating party to civil liability and, where applicable, criminal penalties under applicable law.
7A. Automated Access, Scraping & Data Protection
7A.1 Binding Nature of This Section
By creating an account and accessing the Platform, you enter into a binding contract that expressly prohibits the conduct described in this Section 7A. Violation of this Section constitutes a material breach of contract, actionable regardless of whether the violating conduct also constitutes a violation of any criminal or civil statute.
7A.2 Prohibition on Automated Access
You may not access, query, monitor, copy, or extract data from the Platform by any automated means. This prohibition includes without limitation:
- web scrapers, crawlers, spiders, bots, or automated agents of any kind
- headless browsers or browser automation tools, including Puppeteer, Playwright, Selenium, or substantially similar tools
- scripts, programs, or API calls that access Platform data beyond normal individual human use
- tools that intercept, replay, or automate authenticated API requests or session tokens
- any method that circumvents or bypasses the Platform's user interface to access underlying data
7A.3 Prohibition on Bulk Data Harvesting
You may not collect, compile, store, redistribute, or commercially exploit Platform data in bulk, including:
- downloading or copying crew profiles, employer profiles, or job listings beyond what is necessary for your individual, personal use of the Platform
- building databases, indexes, or directories derived from Platform content
- aggregating Platform data for competitive intelligence, market research, lead generation, or resale
- sharing account credentials or session tokens with third parties for any data extraction purpose
7A.4 Prohibition on AI Training Use
Platform data — including crew profiles, employer profiles, job listings, messages, search results, and any other user-generated or platform-generated content — may not be used for:
- training, fine-tuning, testing, or evaluating any artificial intelligence or machine learning model
- building or improving large language models, generative AI systems, or AI-powered matching or recommendation systems
- contributing to any AI training dataset, whether directly or via an intermediary
- any commercial AI application that derives value from or is informed by Platform content
7A.5 Prohibition on Account Farming
You may not create accounts on the Platform by automated means, in bulk, or for the purpose of data extraction. Creating multiple accounts to circumvent access controls, rate limits, or usage thresholds is prohibited and constitutes a breach of this agreement.
7A.6 Enforcement
Moor's enforcement rights upon violation of this Section include without limitation:
- immediate termination of your account and all associated accounts
- injunctive or other equitable relief to immediately stop prohibited activity — monetary damages alone are considered an inadequate remedy for violations of this Section
- civil damages including actual damages, disgorgement of profits derived from prohibited use, and statutory damages where available
- recovery of reasonable attorney's fees and costs of enforcement
Applicable legal bases for enforcement may include, depending on jurisdiction:
- breach of contract — primary basis, applicable in all jurisdictions
- Washington State Computer Trespass Act, RCW 9A.52.110, and trespass to chattels and unjust enrichment under Washington State common law
- EU Database Directive sui generis database rights (European Union and United Kingdom) — the Platform's crew and employer database constitutes a substantial investment protected against unauthorized extraction or re-utilization
- GDPR violations by the scraping party for unauthorized processing of personal data of EU/EEA residents
- applicable computer misuse, data protection, and intellectual property laws of the user's jurisdiction
The existence of technical access controls on the Platform does not limit or waive any of these rights. Circumventing a technical control to access Platform data does not render the access lawful.
8. Employer Verification
Employers may be asked to verify their identity or affiliation. We may remove employer listings believed to be fraudulent or unsafe.
9. Intellectual Property
All Platform content is the property of Digital Marine, LLC. Users retain ownership of uploaded materials but grant Moor a license to display and process content within the Platform.
The compilation, selection, arrangement, and structure of crew profiles, employer profiles, job listings, and all associated data on the Platform constitutes an original work of authorship owned by Digital Marine, LLC, protected by copyright law in the United States and by equivalent laws in other jurisdictions.
In jurisdictions that recognize database producer rights — including the European Union and United Kingdom under the Database Directive (96/9/EC) and equivalent national legislation — Digital Marine, LLC asserts its rights as a database producer in respect of the Platform's database, reflecting substantial investment in obtaining, verifying, presenting, and maintaining the contents of that database. Unauthorized extraction or re-utilization of a substantial part of the database is prohibited.
No portion of the Platform's data compilation may be reproduced, redistributed, sold, licensed, or used to develop competing products or services — including AI-powered matching, search, or recommendation systems — without the express written consent of Digital Marine, LLC.
10. Privacy
Use of the Platform is governed by our Privacy Policy. Moor complies with GDPR, CCPA, PIPEDA, and other applicable privacy frameworks as relevant.
11. Messaging Disclaimer
Moor provides an in-app messaging feature to allow Crew and Employers to communicate directly. Messages exchanged through the Platform are not monitored, reviewed, or verified by Moor. Users are responsible for exercising their own judgment and should avoid sharing sensitive, financial, or personal information within the messaging system.
12. Limitation of Liability
To the fullest extent permitted by law, Moor is not liable for indirect or consequential damages, financial loss, safety incidents, employment outcomes, or user or vessel misconduct. Your sole remedy is to discontinue use of the Platform.
13. Indemnification
You agree to indemnify and hold harmless Digital Marine, LLC and its employees from claims arising from your use of the Platform, your uploaded content, your violation of these Terms, or your interactions with others.
14. International Use & Employment Law Disclaimer
Users outside the U.S. agree that data is stored in the United States, local employment laws differ, and Moor is not responsible for international compliance. Crew and Employers must comply with their own local and maritime regulations.
Users are further advised that the prohibitions in Section 7A may independently constitute violations of the laws of the user's own jurisdiction, including but not limited to data protection laws (including GDPR for EU/EEA residents), computer misuse laws, database protection laws, and intellectual property laws. Moor's rights under Section 7A exist in addition to and independently of any rights Moor may have under applicable international law.
15. Termination
We may suspend or terminate your account for violating these Terms, unsafe or harmful behavior, or fraudulent or abusive conduct. Termination ends your right to access the Platform.
16. Trademarks
"Moor" and "Moor Yacht Crew" branding may not be used without written permission.
17. Governing Law
These Terms are governed by the laws of Washington State, USA. Disputes will be resolved exclusively in Pierce County, Washington courts.
Notwithstanding the foregoing, nothing in this governing law clause limits Moor's ability to seek injunctive or other equitable relief in any jurisdiction where a violation is occurring or threatened, including in the courts of the European Union, United Kingdom, or any other jurisdiction in which a user resides or operates. Users in jurisdictions that do not permit contractual exclusion of local mandatory law acknowledge that such local mandatory laws — including applicable data protection and database protection laws — continue to apply to their use of the Platform.
18. Advertising Terms (MOOR Ads)
These Advertising Terms apply to all advertisements ("Ads") displayed on MoorCrew.com or purchased through the Moor Ads Portal. By purchasing, submitting, or renewing advertising on Moor, advertisers agree to the Advertising Terms contained in this section as well as all other provisions of these Terms & Conditions.
The Advertising Terms include the rules governing advertising eligibility, early-adopter pricing, subscription renewals, advertiser responsibilities, prohibited content, our right to reject or remove ads, placement standards, performance disclosures, limitations of liability, refund practices, and termination rules. For additional advertising standards, including detailed placement rules, prohibited categories, and review criteria, please also refer to our Advertising Policy.
19. Updates to These Terms
We may update these Terms at any time. The latest version will always be posted with an updated "Last Updated" date. Continued use of Moor constitutes acceptance of updated Terms.
